The objectives of study were: (1) To study the decision of the supreme court which have a direct bearing or which in some form or other touch upon the various fields of education. (2) To study the impact of the decisions in different ways on higher education.
150 Supreme Court & High Court Judges, Advocates, Vice-Chancellors and Educational Authorities were selected as a Sample.
Interview Schedule and Questionnaire developed by Researcher were used for data collection.
Descriptive Survey Method was used in Research. The data were analyzed trough Content Analysis Method.
The findings of study were: (1) The decision of the supreme court has proved to be a spring board in the growth and development of higher education. (2) The education has now been treated as one of the fundamental right flowing directly from ‘right to life’ as embodied in article 21 of the constitution. (3) In view of the judicial pronouncement of the apex court, education is not a business, trade, profession or occupation. (4) Merit cannot be sacrificed at any cost. (5) The concept of equality, fairness and propriety has been introduced in the system.
